Our Family Team here at Leathes Prior are all members of Resolution, a community of family law professionals who work with families and individuals to resolve matters in a conciliatory manner. A large part of what Resolution do is campaign for change, and this year, on their 40th Anniversary and in line with their Awareness Week (27 Nov – 1 Dec) (formerly Good Divorce Week), Resolution have launched a campaign titled ‘Vision for Family Justice’. The campaign looks to raise awareness for reforms which its members feel need to be made in order to have a fairer and more modern family justice system, reflective of modern families, particularly focusing on reform for cohabitation (rights for unmarried couples).
The summary of recommendations includes:
Recognising the changing face of families – focusing on unmarried couples and modern families.
Helping families to find solutions – focusing on more public funding & access to early legal information & advice and ensuring co-parenting programmes happening sooner.
Protecting the vulnerable – looking at what more needs to be done to support and protect victims of domestic abuse in the family court, support for children and ensuring legal aid is available.
Ensuring family courts meet the needs of families – looking at preventing closures of family courts and ensuring online processes are evaluated on a case-by-case basis.
Making family law fit for purpose – focusing on child arrangements on separation or divorce, improving the operation of public children law, the law relating to financial remedies on divorce and international cases.

The Value of Planning Ahead: LPAs & Court of Protection
Putting LPAs in place allows you to choose trusted people to make decisions for you if you lose capacity in the future. This avoids the need for loved ones to make a costly and time-consuming deputyship application to the Court of Protection. With more people likely to experience conditions affecting capacity, more families may need to turn to the Court for support where no LPAs are in place.
