Danny’s expertise covers a broad range of the firm’s specialist areas. He deals with property litigation, commercial disputes and insolvency/enforcement matters.

Danny’s particular emphasis is on property litigation matters, including landlord and tenant disputes; service charge disputes; forfeiture; possession proceedings; lease extension and enfranchisement disputes and real property disputes.

Danny’s commercial litigation work includes contractual disputes, franchise disputes and debt recovery. Danny also advises clients in relation to construction disputes and has experience dealing with adjudications as well as enforcement in the Technology and Construction Court.

Experienced in acting for clients at mediation and exploring alternative dispute resolution, Danny takes a pragmatic and commercial approach to disputes and enjoys looking at creative solutions to clients’ legal issues.

  • Represented commercial landlord in relation to forfeiture proceedings involving breaches of covenant by the tenant including failure to pay rent, breaches of user covenant and breaches relating to nuisance and environmental damage. In addition to obtaining forfeiture, the landlord obtained judgment in respect of the entirety of its legal costs.
  • Acted for a residential landlord on a difficult defended possession matter. Possession was obtained by the landlord and subsequently the tenant made an application to set aside the possession order and permission to file a further defence. The tenant sought to defend the claim on the grounds that the prescribed information had been incorrectly served in relation to a deposit taken some 5 years prior, a failure to serve an updated valid energy performance certificate and on grounds that the tenant was disabled and the steps taken in serving notice and seeking possession through the court was a breach of the Equality Act 2010. Evidence was sought and obtained from computer files which dealt with the first two issues and medical evidence was reviewed and discredited to the extent that the parties entered into an agreement whereby possession was given back to the landlord.
  • Successfully represented a building contractor in connection with a payment dispute under a construction contract. The matter was referred to adjudication, as the referring party, the client was successful in obtaining a decision of the adjudicator in its favour and, following a failure to comply with the adjudicator’s award, enforced the decision through the Technology and Construction Court, reaching settlement part way through enforcement resulting in payment of the original award and all of the referring parties costs in relation to the enforcement action.
