On completion of your purchase and after the Stamp Duty Land Taxes formalities have been completed, it is necessary to register the property and your ownership at the Land Registry. There are two types of registration:-
First Registration – where the property you are purchasing is unregistered and an application has to be made to the Land Registry for registration. This process usually takes a while to be completed as the Land Registry need to read through the deeds to the property, extracting all essential information and producing a title information document. The title information document is a condensed version of the deeds.
Application To Change The Register – this is completed where the property is already registered at the Land Registry and they are merely being informed of a change of ownership and/or mortgage details.
If you own property or land which is not currently registered it is possible to apply to the Land Registry for voluntary registration. Registering the property or land has the advantage in that once registered the Land Registry guarantee the title to the property or land. It also prevents pieces of land being lost to neighboring property or land. Once registered, should anybody try to register a piece of land belonging to you, the Land Registry will alert you of this. Otherwise the only time you will be aware of land being lost will be when it is registered and the Land Registry produce a plan or raise enquiries. Claiming back land or trying to amended another persons registration can be a lengthy and costly process.
